1. Acceptance of Terms
By engaging the services of RS Shipping Maritime Services OPC or utilizing this platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you are acting on behalf of a shipowner, charterer, or corporation, you warrant that you possess the explicit legal authority to bind that entity.
2. Provisions & Ship Chandling Services
All supply orders for ship stores, fresh or frozen provisions, deck and engine supplies, or cabin necessities are fulfilled based on explicit electronic availability confirmations. Any modifications or cancellations to active provision requests must be filed at least 48 hours prior to the scheduled vessel arrival or absolute drop cutoff window.
3. Fees, Estimates, and Payments
All financial quotations provided are estimations based on present market tariffs, port declarations, and logistical surcharges. Final invoices will reflect absolute actual expenditures incurred during agency operations. Unless explicitly governed by a separate credit arrangement, payment obligations are due immediately upon presentation of the invoice.
4. Demurrage and Delays
RS Shipping Maritime Services OPC shall not be held liable or responsible for cargo delays, structural hold-ups, port congestions, custom processing intervals, or vessel detentions caused by weather anomalies, force majeure conditions, or sudden regulatory policy changes issued by local maritime port authorities.
5. Limitation of Liability
To the maximum extent permitted under applicable maritime regulation and laws, our total aggregate liability for any operational loss, cargo damage, or supply delivery discrepancies is strictly capped at the direct total service fee value paid for that specific individual transit engagement.
6. Governing Law and Jurisdiction
These terms and conditions are executed and interpreted under the active governing laws and regulations of the Republic of the Philippines. Any litigation, contractual disputes, or legal arbitration arising out of or regarding our professional services will fall exclusively under the jurisdiction of competent local courts.
7. Modifications to This Agreement
We reserve the right to revise, alter, or update portions of these operational terms at any point without prior notice to maintain complete structural alignment with ever-evolving domestic port regulations and safety guidelines.
